The incident began just after 8:15 a.m. on Monday, Feb. 13 at the 1520 East High Street store, Pottstown police said in a statement.

A 37-year-old man was fueling up at the gas pump when a 19-year-old man approached him with an accomplice, according to investigators. Police said security footage shows the 19-year-old and his companion assaulting the 37-year-old as he tries to retreat.

At some point, police said the 37-year-old drew a handgun and fired once, hitting the pavement. The bullet ricocheted and hit a 58-year-old man who was walking across the parking lot, they said.

The victim, a Lower Pottsgrove resident, was evacuated by helicopter with injuries to his face and left eye, authorities wrote. Police said he was taken to a trauma center but his condition as of Monday afternoon is unclear.

The 37-year-old who pulled the trigger stayed on the scene to wait for police, and has a legal concealed carry permit, officials said.

According to investigators, the 37-year-old was "involved in a domestic situation" with his girlfriend at their Lower Pottsgrove home over the weekend. Detectives said the 19-year-old is his girlfriend's son.

The teen fled before first responders arrived, the department said. Police are continuing to review the footage and will work with the Montgomery County District Attorney's Office to determine if charges will be filed.
